Terms & Conditions for ConfluenceEdge Products
Scope
These GTC apply to all contracts between Christian Burkardt (ConfluenceEdge) and consumers for digital products (SaaS subscription, Pine Script indicators).
Contract and Performance
The contract is concluded directly between me and the buyer. Performance (access) is immediate after payment via Whop.
License
The buyer receives a non-exclusive, non-transferable, personal license for own use. Transfer, reproduction or commercial use is prohibited.
Subscriptions
Monthly subscriptions renew automatically. Cancellation is possible at any time to the end of the current month.
Immediate Performance and Loss of Right of Withdrawal
The digital products (Dashboard access and Pine Script indicators) are provided immediately after payment. The customer expressly agrees that they will receive the digital content immediately and that their right of withdrawal expires upon receipt of access. By purchasing, the customer consents to performance beginning before the end of the withdrawal period and acknowledges that they thereby lose their right of withdrawal (§ 356(5) BGB).
Liability and Disclaimer
The products (Macro + COT + Valuation Dashboard, Pine Script indicators/tools) are provided exclusively for informational and educational purposes. They do not constitute investment advice, financial advice, financial analysis, investment recommendation, solicitation to buy, sell or hold financial instruments or any other advice (§ 34b WpHG, FinAnV, MAR). No personalised advice or signals are provided. Trading involves significant risk of loss up to total loss of invested capital. Past or simulated performance is not indicative of future results. I assume no liability whatsoever for direct or indirect damages, losses or disadvantages arising from the use of the products. Any trading or investment decision is the sole responsibility of the user, who should seek professional advice. Liability is limited to intent and gross negligence.
Governing Law
German law applies. Place of jurisdiction for consumers is their place of residence or Zweibrücken.
Geltungsbereich
Diese AGB gelten für alle Verträge zwischen Christian Burkardt (ConfluenceEdge) und Verbrauchern über digitale Produkte (SaaS-Abo, Pine-Script-Indikatoren).
Vertragsschluss und Leistung
Der Vertrag kommt direkt zwischen mir und dem Käufer zustande. Die Leistung (Zugang) erfolgt sofort nach Zahlung über Whop.
Lizenz
Der Käufer erhält eine nicht-exklusive, nicht übertragbare, persönliche Lizenz zur eigenen Nutzung. Weitergabe, Vervielfältigung oder kommerzielle Nutzung ist untersagt.
Abonnements
Monatliche Abos verlängern sich automatisch. Kündigung ist jederzeit zum Ende des laufenden Monats möglich.
Sofortige Leistungserbringung und Widerrufsrecht
Die digitalen Produkte (Dashboard-Zugang und Pine Script Indikatoren) werden unmittelbar nach Zahlungseingang bereitgestellt. Der Kunde stimmt ausdrücklich zu, dass er die digitalen Inhalte sofort erhält und dass sein Widerrufsrecht mit Erhalt des Zugangs erlischt. Mit dem Kauf erklärt der Kunde sein Einverständnis, dass die Leistung vor Ablauf der Widerrufsfrist erbracht wird, und nimmt zur Kenntnis, dass er dadurch sein Widerrufsrecht verliert (§ 356 Abs. 5 BGB).
Haftung und Disclaimer
Die Produkte (Macro + COT + Valuation Dashboard, Pine Script Indikatoren/Tools) dienen ausschließlich zu Informations- und Bildungszwecken. Sie stellen in keiner Weise eine Anlageberatung, Finanzberatung, Finanzanalyse, Investmentempfehlung, Aufforderung zum Kauf, Verkauf oder Halten von Finanzinstrumenten oder sonstige Beratung dar (§ 34b WpHG, FinAnV, MAR). Es werden keine personalisierten Ratschläge oder Signale erteilt. Trading birgt erhebliche Verlustrisiken bis hin zum Totalverlust des eingesetzten Kapitals. Vergangene oder simulierte Wertentwicklungen sind kein Indikator für zukünftige Ergebnisse. Ich übernehme keinerlei Haftung für direkte oder indirekte Schäden, Verluste oder Nachteile aus der Nutzung der Produkte. Jede Trading- oder Anlageentscheidung liegt allein in der Verantwortung des Nutzers, der professionellen Rat einholen sollte. Haftung ist auf Vorsatz und grobe Fahrlässigkeit beschränkt.
Anwendbares Recht
Es gilt deutsches Recht. Gerichtsstand für Verbraucher ist deren Wohnsitz oder Zweibrücken.
